New EEOC Proposed Wellness Regulations – Next Steps for Employers

 

On April 16, 2015, the Equal Employment Opportunity Commission (“EEOC”) issued a long-awaited proposed regulation (“Proposed Regulation”) with respect to employer-sponsored wellness programs and the Americans with Disabilities Act (“ADA”). While not yet final, the Proposed Regulation provides importance guidance on the extent to which employers may use incentives to encourage employees to participate in wellness programs that include disability-related inquiries and/or medical examinations.

In this webinar, co-presented by Seth Peretta, Principal at Groom Law Group and Bryce Williams, CEO and President of HealthMine, participants will learn:

  • What are the (proposed) new federal rules when it comes to wellness programs? Specifically, we will cover the key elements of the EEOC’s new guidelines including:
  • “Reasonable Design” to promote health or prevent disease
  • How to proceed if you already have a wellness program in place
  • What to do if you’re in the process of designing a new wellness program
  • Determining whether your program meets the proposed new requirements and standards while also addressing consumer needs
